Terms of Service

By accessing or using iWrestle (the "Service"), operated by Gabriel Rao, d/b/a iWrestle ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

If you are under 18 years of age, your parent or legal guardian must agree to these Terms on your behalf. If you are under 13 years of age, your parent or legal guardian must provide verifiable consent as described in our Privacy Policy before you may use the Service.

iWrestle is a wrestling video analysis platform that allows wrestlers to upload match footage and receive technique analysis, feedback, and training recommendations. The Service includes:

• Video upload and analysis: upload wrestling match videos to receive analysis of techniques, scoring, strengths, and areas for improvement.
• Wrestler Performance Index (WPI): a performance score calculated from your analyzed matches.
• Social feed: a community feed where wrestlers can share highlights and react to others' content.
• Public wrestler profiles: profiles that display your WPI, match history, and shared analyses.

iWrestle is designed for wrestlers ages 10–20. The following age-based requirements apply:

• Users under 13: require verifiable parental consent before creating an account or using the Service. The parent or legal guardian is responsible for the account and must agree to these Terms.
• Users ages 13–17: may create an account with the consent of a parent or legal guardian. The parent or legal guardian must agree to these Terms.
• Users 18 and older: may create an account independently and agree to these Terms on their own behalf.

We reserve the right to terminate any account if we discover the user does not meet the applicable age and consent requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to:

• Provide accurate information: all account information must be truthful and current.
• Secure your account: use a strong password and notify us immediately of any unauthorized access.
• One person per account: accounts are personal and may not be shared or transferred.

We reserve the right to suspend or terminate accounts that violate these Terms.

5.1 Free Tier

New accounts receive a limited number of free analyses. Once free analyses are exhausted, a paid subscription or analysis pack is required to continue using the analysis feature.

5.2 Paid Plans

Paid plans are available as monthly subscriptions, annual subscriptions, or one-time analysis packs. Prices are displayed in the Service before purchase. All payments are processed through Stripe.

5.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through the Service. Cancellation takes effect at the end of the current billing period.

5.4 Refunds

Refund requests are evaluated on a case-by-case basis. If an analysis fails to generate results due to a technical error on our end, we will credit the analysis back to your account. Contact us at privacy@iwrestle.app for refund requests.

5.5 Minors and Payments

All purchases for users under 18 must be made by or authorized by a parent or legal guardian. We are not responsible for unauthorized purchases made by minors.

6.1 Your Content

You retain ownership of all content you upload to the Service, including wrestling videos, profile information, and social feed posts ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to:

• Process and analyze: your videos using our analysis service.
• Store and display: your content within the Service as necessary to provide features you use (e.g., your profile, shared analyses, social feed).
• Create derivative works: generate analysis reports, highlight clips, and performance metrics from your videos.

This license terminates when you delete your content or account, except for aggregate, de-identified data that has already been incorporated into our training data.

6.2 Content Restrictions

You agree not to upload or share content that:

• Is illegal, harmful, or offensive, including content that promotes violence, harassment, or discrimination.
• Infringes rights, including copyright, trademark, or privacy rights of others.
• Contains personal information of others without their consent.
• Is sexually explicit or inappropriate given the platform's audience of minors.
• Is fraudulent or deceptive, including impersonating other wrestlers or misrepresenting your identity.

We reserve the right to remove any content that violates these restrictions without notice.

The analysis provided by iWrestle is generated by machine learning systems and is intended for informational and training purposes only. The analysis:

• Is not a substitute for professional coaching: analysis should supplement, not replace, qualified wrestling coaching.
• May contain inaccuracies: systems can misidentify techniques, misinterpret scoring situations, or provide feedback that may not be optimal for your specific situation.
• Does not constitute medical advice: do not rely on analysis for decisions about weight management, injury prevention, or physical conditioning. Consult appropriate medical professionals.

We are not liable for any injury, loss, or damage arising from reliance on generated analysis.

You agree not to:

• Attempt to bypass rate limits, exploit vulnerabilities, or use automated tools to access the Service.
• Disrupt the Service, overload servers, or introduce malicious code.
• Scrape, crawl, or collect data from the Service without authorization.
• Redistribute analysis commercially without our written permission.
• Use the social feed or any feature to harass, intimidate, or bully other users.
• Attempt to disable or bypass any content moderation or safety features.

The Service, including its design, code, analysis algorithms, branding, and all content created by us, is the property of Gabriel Rao, d/b/a iWrestle and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service except your own User Content.

You may delete your account at any time. Upon deletion, we will remove your personal information in accordance with our Privacy Policy and data retention schedule.

We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. We will provide notice when reasonably possible.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Gabriel Rao, d/b/a iWrestle shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to injuries sustained during wrestling practice or competition based on analysis, loss of data, or unauthorized access to your account.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Gabriel Rao, d/b/a iWrestle from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the State of Hawaii. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class arbitration.

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service and, where required, by email. Continued use of the Service after changes constitutes acceptance.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
